The Complainant had insured her cattle feed plant along with stocks and machinery under a standard Fire Policy with National Insurance Co. Ltd. there was heavy flood on 18.06.2008 and the stocks were badly affected. Complainant had claimed compensation of Rs. 10,13,600/-. The Insurance Company has repudiated the claim on the grounds that fraudulent means were adopted to prefer the claim.
The Hon’ble Ombudsman heard the case on 28.11.2009 in a camp hearing at Balasore, where both parties were present. After hearing both parties and perusing the documents Hon’ble Ombudsman observed that the damage due to flood water is not disputed and the complainant through anxiety produced some photographs which exaggerated the flood volume. Therefore set aside the repudiation decision of the insurer and recommended settlement of the loss on non standard basis at Rs 4,58,153/-.
